Most railways have their own police, but also rely on local cops to keep an eye out. So basically, the act of taking the photo isn't illegal, but where you're taking it is, if you're on railroad property. Maybe you should just try to find a cool, old barn as a back drop. Check with the farmer, first. they always have shotguns.
