The first jury couldn't reach a verdict. The second trial began Wednesday morning and ended Thursday afternoon. After a short deliberation the jurors decided there was insufficient evidence to convict the former Pasco officer of rape.

The allegations were made back in 2014. A young woman said she had dinner and drinks with Aguirre and his wife and asked to stay the night rather than drive home intoxicated. She says she awoke to him making sexual contact.

The Tri-City Herald reported earlier today that the defense team's DNA experts said the amount of DNA on the woman's underwear was so minimal it was unlikely it was there as a result of direct (especially sexual) contact. Trace amounts of DNA can end up on underwear because it passes through clothing (at the microscopic level).

Aguirre is still accused of murder in Spokane.
