An Aug. 25 crash caused by a 60-year-old Everett man near Kennewick resulted in the rolling of a truck and 12-foot camper. Authorities believe it was a result of drunk driving but the plaintiff is pleading innocent... because he's a police officer.

Jimmy Phillips is in charge of the investigations division at the Everett, Washington police department. State troopers say his breath-alcohol test after the crash was .207 -- way over the legal limit of .08.

The case is in Benton County court and Phillips is on leave from the police department.
